But this principle does not apply to the gun industry, because it has obtained <a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/giffords.org\/lawcenter\/gun-laws\/policy-areas\/other-laws-policies\/gun-industry-immunity\/\" target=\"_blank\" rel=\"noopener\" data-href=\"https:\/\/giffords.org\/lawcenter\/gun-laws\/policy-areas\/other-laws-policies\/gun-industry-immunity\/\">unprecedented immunity<\/a> from this important system of accountability.<\/p>\n<p class=\"graf graf--p\"><strong class=\"markup--strong markup--p-strong\">Lawsuits against gun manufacturers are prohibited by the Protection of Lawful Commerce in Arms Act. When the bill became law in 2005, <\/strong><strong class=\"markup--strong markup--p-strong\">the NRA said<\/strong><strong class=\"markup--strong markup--p-strong\"> it was \u201c the most significant piece of pro-gun legislation in twenty years.\u201d<\/strong><\/p>\n<p class=\"graf graf--p\">The federal law allows for six exceptions in which lawsuits may be brought against gun manufacturers. <em class=\"markup--em markup--p-em\">One of them is for manufacturers who violate state or federal laws governing the marketing or sales of guns.<\/em><\/p>\n<p class=\"graf graf--p\">The marketing exception helped parents of children killed in the 2012 Sandy Hook Elementary School massacre successfully sue Remington Arms last year. The families of nine Sandy Hook school shooting victims were awarded <a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/www.nytimes.com\/2022\/02\/15\/nyregion\/sandy-hook-families-settlement.html\" target=\"_blank\" rel=\"noopener\" data-href=\"https:\/\/www.nytimes.com\/2022\/02\/15\/nyregion\/sandy-hook-families-settlement.html\">$73 million<\/a> as a result of the lawsuit.<\/p>\n<p class=\"graf graf--p\">According to <a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/calmatters.org\/justice\/2022\/05\/california-gun-control-bill\/\" target=\"_blank\" rel=\"noopener\" data-href=\"https:\/\/calmatters.org\/justice\/2022\/05\/california-gun-control-bill\/\"><em class=\"markup--em markup--p-em\">CalMatters<\/em><\/a>, the survivors of the 2019 shooting at a San Diego area synagogue also successfully argued that Smith &amp; Wesson used marketing \u201cthat attracted impulsive young men with military complexes who were particularly likely to be attracted to the unique ability of AR-15 style weapons.\u201d<\/p>\n<p class=\"graf graf--p\">To entertain the claims more thoroughly, let\u2019s view some of Smith &amp; Wesson\u2019s marketing materials.<\/p>\n<p><span class=\"embed-youtube\" style=\"text-align:center; display: block;\"><iframe loading=\"lazy\" class=\"youtube-player\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/fYZiIyOoTLE?version=3&#038;rel=1&#038;showsearch=0&#038;showinfo=1&#038;iv_load_policy=1&#038;fs=1&#038;hl=en-US&#038;autohide=2&#038;wmode=transparent\" allowfullscreen=\"true\" style=\"border:0;\" sandbox=\"allow-scripts allow-same-origin allow-popups allow-presentation allow-popups-to-escape-sandbox\"><\/iframe><\/span><\/p>\n<p class=\"graf graf--p\">Does the video above do a good job of \u201cmoving metal,\u201d to borrow a phrase from the automobile industry? And who is this video appealing to? Future SWAT team members?<\/p>\n<p class=\"graf graf--p\">There are dozens more videos on the brand\u2019s YouTube page. I cherry-picked one that neatly illustrates how the marketing of high-powered automatic weapons is not about hunting, it\u2019s about acting out real-life war games. Where people die.<\/p>\n<h3 class=\"graf graf--h3\">Like Guns Themselves, Gun Advertising Is Mostly Unregulated<\/h3>\n<p class=\"graf graf--p\">How do we bring a rogue industry to a better place? Can we force the gun makers and sellers to the table and make them play nice?<\/p>\n<p class=\"graf graf--p\">In 1997, <a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/www.nytimes.com\/1997\/06\/21\/us\/cigarette-makers-in-a-368-billion-accord-to-curb-lawsuits-and-curtail-marketing.html\" target=\"_blank\" rel=\"noopener\" data-href=\"https:\/\/www.nytimes.com\/1997\/06\/21\/us\/cigarette-makers-in-a-368-billion-accord-to-curb-lawsuits-and-curtail-marketing.html\">a complex agreement<\/a> negotiated by a group of state attorneys general, plaintiffs\u2019 lawyers, and industry representatives, required big tobacco to pay <strong class=\"markup--strong markup--p-strong\">$368.5 billion over 25 years<\/strong> to compensate states for the costs of treating smoking-related illnesses, to finance nationwide anti-smoking programs and to underwrite health care for millions of uninsured children.<\/p>\n<p class=\"graf graf--p\">There\u2019s no such agreement to keep firearms out of the hands of children\u200a\u2014\u200ain ads or in real life. This partly explains why a new ad from the Georgia-based maker of the AR-15 used in the Uvalde massacre features a toddler cradling an AR-15 like it\u2019s the best gift ever.<\/p>\n<p class=\"graf graf--p graf--startsWithDoubleQuote\">\u201c<strong class=\"markup--strong markup--p-strong\">Train up a child in the way he should go, and when he is old, he will not depart from it<\/strong>,\u201d <a class=\"markup--anchor markup--p-anchor\" href=\"https:\/\/nypost.com\/2022\/05\/27\/daniel-defense-posted-ar-15-ad-with-kid-before-texas-massacre\/\" target=\"_blank\" rel=\"nofollow ugc noopener\" data-href=\"https:\/\/nypost.com\/2022\/05\/27\/daniel-defense-posted-ar-15-ad-with-kid-before-texas-massacre\/\">Daniel Defense wrote in the ad<\/a> shared on Twitter on May 16, eight days before the slaughter at Robb Elementary School.<\/p>\n<p class=\"graf graf--p\">The line refers to a proverb in the <em class=\"markup--em markup--p-em\">Bible<\/em>.<\/p>\n<h3 class=\"graf graf--h3\">The West Is Won, Turn In Your\u00a0Gun<\/h3>\n<p class=\"graf graf--p\">Since the advertising industry will not self-regulate and the gun industry will not stop pumping their chambers until \u2018We, the People\u2019 stop them, what else can be done?<\/p>\n<p class=\"graf graf--p\">We can make and place public service ads for gun control. Do you remember these iconic campaign lines?<\/p>\n<ul>\n<li class=\"graf graf--h4\">\n<h4>Seat Belts Save\u00a0Lives.<\/h4>\n<\/li>\n<li class=\"graf graf--h4\">\n<h4>Only <em class=\"markup--em markup--h4-em\">You<\/em> Can Prevent Wildfires.<\/h4>\n<\/li>\n<li class=\"graf graf--h4\">\n<h4>Keep America Beautiful.<\/h4>\n<\/li>\n<\/ul>\n<p><span class=\"embed-youtube\" style=\"text-align:center; display: block;\"><iframe loading=\"lazy\" class=\"youtube-player\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/h0sxwGlTLWw?version=3&#038;rel=1&#038;showsearch=0&#038;showinfo=1&#038;iv_load_policy=1&#038;fs=1&#038;hl=en-US&#038;autohide=2&#038;wmode=transparent\" allowfullscreen=\"true\" style=\"border:0;\" sandbox=\"allow-scripts allow-same-origin allow-popups allow-presentation allow-popups-to-escape-sandbox\"><\/iframe><\/span><\/p>\n<p class=\"graf graf--p\">What\u2019s the \u201cGun Control Now\u201d line that opens minds and changes hearts? \u201cGun Control Now\u201d is too demanding and abrupt. We need persuasive copy and campaigns from the industry\u2019s best makers to work on this challenge.<\/p>\n<p class=\"graf graf--p\">Too many Americans believe they have a God-given right to a gun. Too few Americans have ever read the Constitution or <em>The Bible<\/em>. The Second Amendment says, members of &#8220;a well-organized militia\u201d can have a gun. Teens with a death wish are not part of any militia, well-organized or not. Soccer dads and moms who are armed to the teeth are not part of any militia. A select few Americans have any right to a gun whatsoever.<\/p>\n<p class=\"graf graf--p\">Now, how do we convey the truth of this to the people of this nation? How do we move people to care more about saving lives than destroying them? How do we reclaim the public square in America? Lawsuits and ad campaigns alone won\u2019t do it, but these are effective tools we have in the toolbox.
